1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "user") and NOW (Aust) Pty Ltd, trading as Fix My Bad Credit ("we", "us", "our"), governing your use of the website fixmybadcredit.com.au and related services ("Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.

2. Description of Services

Fix My Bad Credit is a lead capture and credit file analysis platform. Our Services include:

  • Credit File Analysis: We provide tools to help you understand your credit file, identify potential errors, defaults, and negative listings.
  • Qualification Assessment: We assess your situation to determine whether professional credit repair services may benefit you.
  • Credit File Ordering: We facilitate ordering of your credit files from major Australian credit bureaus (Equifax, Illion, CreditorWatch).
  • DIY Resources: We provide educational resources and guides for self-directed credit repair.
  • Professional Referral: Qualified prospects are referred to MyCRA Lawyers (Legal Practice Holdings Group) for professional credit repair and legal services.

3. Important Disclaimers

3.1 Not a Law Firm

Fix My Bad Credit is not a law firm and does not provide legal advice. Any information provided through our platform is general in nature and should not be relied upon as legal advice. For legal advice regarding your credit file or financial situation, you should consult a qualified legal practitioner.

3.2 Not Financial Advice

The information provided through our Services does not constitute financial advice. We do not hold an Australian Financial Services Licence (AFSL). For financial advice, you should consult a qualified financial adviser.

3.3 No Guarantee of Outcomes

We do not guarantee any specific outcomes regarding your credit file, credit score, or the removal of any listings. Results vary depending on individual circumstances, and the accuracy and completeness of information you provide.

4. User Accounts

4.1 Registration

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

4.2 Password Security

You are responsible for maintaining the confidentiality of your password. Passwords must meet our minimum security requirements (at least 12 characters, including uppercase, lowercase, numbers, and special characters). We strongly recommend enabling two-factor authentication (2FA) for added security.

4.3 Account Termination

We reserve the right to suspend or terminate your account if you breach these Terms, provide false information, or use our Services for any unlawful purpose.

When using our Services, you agree to:

  • Only upload documents that belong to you or that you are authorised to share
  • Not use the Services for any illegal or fraudulent purpose
  • Not attempt to gain unauthorised access to our systems or other users' accounts
  • Not interfere with the proper functioning of the website
  • Comply with all applicable Australian laws and regulations

6. Payment Terms

6.1 Fees

Certain Services require payment, including:

  • Consultation Fee: $99 for standard consultations, $139 for priority consultations. Consultation fees may be credited toward the cost of professional services if you proceed.
  • Credit File Orders: Fees for ordering credit files from credit bureaus vary and are displayed at the time of order.

6.2 Payment Processing

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service. We do not store your full credit card details on our servers.

6.3 Refunds

Consultation fees are generally non-refundable once a consultation has been provided. Credit file order fees are non-refundable once the order has been submitted to the credit bureau. Refund requests for unused services may be considered on a case-by-case basis.

7. Intellectual Property

All content on our website, including text, graphics, logos, software, and design elements, is the property of NOW (Aust) Pty Ltd or its licensors and is protected by Australian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on our website without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our Services are provided "as is" and "as available" without any warranties, express or implied
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services
  • Our total liability to you for any claim arising from these Terms shall not exceed the amount paid by you to us in the 12 months preceding the claim
  • We are not responsible for actions taken by MyCRA Lawyers or any third party to whom you may be referred

Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded or limited by law.

9. Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.

10. Termination

You may close your account at any time by contacting us. We may terminate or suspend your access to our Services immediately, without prior notice, if:

  • You breach any provision of these Terms
  • You provide false, inaccurate, or misleading information
  • We are required to do so by law
  • We discontinue the Services (with reasonable notice)

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, limitation of liability, and dispute resolution.

11. Dispute Resolution

11.1 Internal Resolution

If you have a complaint or dispute, please contact us first by phone at 1300 667 218. We will endeavour to resolve your complaint within 30 business days.

11.2 External Dispute Resolution

If we are unable to resolve your complaint to your satisfaction, you may refer the matter to:

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising from these Terms or your use of our Services.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through our website or via email. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NOW (Aust) Pty Ltd regarding your use of our Services, and supersede all prior agreements and understandings.
